Terms of Service

Welcome to NetQA. This Terms of Service agreement (the "Agreement") is a legal agreement between WebQA, Inc. ("NetQA,", "WebQA", "we," "us", or "our") and you ("member", "you" or "user"), governing your use of NetQA. ("Site", "NetQA", "System" or "Service"). By accessing the NetQA website or using the services offered by NetQA ("Services") you agree and acknowledge to be bound by these Terms of Service ("Terms"). If you do not agree to or cannot comply with these Terms, our Privacy Policy and any other posted guidelines, rules or notices, do not access the Site or use the Services effective immediately. WebQA reserves the right to change these Terms at any time without prior notice. We recommend that you periodically review the Terms for any changes. If you do not agree to, or cannot comply with, the Agreement as amended, you must stop using the Service immediately. If you continue to use the Service after any amendments are posted, you will be deemed to have accepted the Agreement as amended.

Description of Service

You understand and agree that the Service may include communications from NetQA, such as service announcements, administrative messages and others as required, and that these communications are considered part of the service. You will not be able to opt out of receiving communications. Unless explicitly stated otherwise, any new features that supplement or enhance the current Service, shall be subject to the Terms.

User Responsibility

You are responsible for obtaining access to the Service, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are solely responsible for those fees, including any fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service. You are solely responsible for your use of the Site and Services. NetQA is only a repository of information. All content, including comments does not represent the advice, views, opinions or beliefs of WebQA and WebQA makes no claim of accuracy of any Site or user-posted content. Users may post links to third-party websites and the linked websites' content, business practices and privacy policies are not under our control, and we are not responsible for the content of any linked website or any link contained in a linked website. The insertion of a link on the Site or Services does not imply any endorsement by or any affiliation with WebQA. In accessing the Site and Services or following links to third-party websites you may be exposed to content that you consider offensive or inappropriate. You fully agree that your only action for recourse is to stop using the Site and Services. You are also solely responsible for maintaining the security and confidentiality of your password and other Member account information. You agree not to permit others to use your password or other Member account information, and you agree to notify WebQA immediately of any unauthorized use. WebQA will not be responsible for any loss or damage arising out of the unauthorized use of your password or other Member account information; and you agree to indemnify and hold harmless WebQA, its officers, directors, agents, and employees, for any unauthorized, improper, or illegal use of that information. You, and not WebQA, are solely responsible for all Content (defined below) published, distributed, or displayed through your account, including without limitation any e-mail messages, bookmarks, member ID's, descriptions, comments, or tags, and for your interactions with other Members.

Term

This Agreement shall remain in full force and effect the entire time you use the Service and/or are a Member in the Service. In the event that membership is terminated, all provisions of this Agreement which must survive in order to give effect to their meaning, including without limitation all of your representations, warranties, and indemnification obligations, shall survive. By using the Service and/or becoming a Member, you acknowledge that WebQA has the right to charge for the Service and terminate your membership should you violate this Agreement or fail to pay for the Service as required.You agree that WebQA may, under certain circumstances and without prior notice, immediately terminate your WebQA account, any associated member ID, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the Terms or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your WebQA account includes (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in WebQA's sole discretion and that WebQA shall not be liable to you or any third party for any termination of your account, any associated member ID, or access to the Service.

Member Conduct

You understand and agree that all information, data, text, photographs, graphics, comments, messages, tags or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not WebQA, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. WebQA does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will WebQA be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

Dealings with Advertisers

You fully understand and agree that the Service may include advertisements and the advertisements are necessary for WebQA to provide the Service. All communication, correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that WebQA shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Privacy Policy Overview This privacy policy covers WebQA's treatment of personally identifiable information that we collect when you are on our site, and also when you use our services.

Furthermore, this policy applies to WebQA's treatment of any personally identifiable information that our business partners share with us. This policy does not apply to the practices of companies that we do not own or control, or to people that we do not employ or manage.

Information Collection and Use
We may collect personally identifiable information when you visit or use our pages. We may also receive personally identifiable information from our business partners. We also automatically receive and record information on our server logs from your browser including your IP address, cookie information and the page you requested. We may use this information for three general purposes: to customize the content you see, to fulfill your requests for certain services and information, and to contact you.

Information Sharing and Disclosure
We will not sell or rent your personally identifiable information to anyone. We will send personally identifiable information about you to other companies or people when: (1) we have your consent to share the information; (2) we need to share your information to provide the product or service you have requested; (3) we need to send the information to companies who work on behalf of WebQA to provide a product or service to you (unless we tell you differently, these companies do not have any right to use the personally identifiable information we provide to them beyond what is necessary to assist us); (4) we respond to subpoenas, court orders or legal process; or (5) we find that your actions on our web sites violate the above terms of service, or any of our usage guidelines for specific products or services.
